      Abstract

LOBATO, Anderson Orestes Cavalcante. Politics, constitutions and justice: challenges regarding the consolidation of democratic institutions . Rev. Sociol. Polit., Nov. 2001, no.17, p.45-52. ISSN 0104-4478.

Political actors find the institutional boundaries for democratic politics in the Constitution. Nonetheless, the constitutional text is unable to offer the necessary conditions for government stability. To concretize government policies, the Constitution must be reformed and coupled with a uniform constitutional jurisprudence; in this regard, Constitutional Justice belongs at the heart of democratic political debate. balancing the tension between politics and law. The tension that exists between the government's political will and the will of the Constitution can only be balanced by the Judiciary, an institution that is undergoing a crisis of legitimacy, organization and process.

Keywords: constitutionality; democracy; constitutional justice; Judiciary reform; judicialization of politics.
