PARKING POLICY

 

 

Chapter 1

 

VEHICLE PARKING

 

 

SECTION 1.00 – BACKGROUND

 

Title V of the California Code of Regulations provides that parking fees shall be assessed to park vehicles upon CSU campuses.  Parking fees will be used to fund the operations, maintenance, and construction of parking facilities only.

 

Under section 21113(a) of the California Vehicle Code, a parking permit must be displayed as evidence as payment of said parking fee. 

 

SECTION 1.01 – PARKING PERMITS

 

Any vehicle parking on the grounds of California State University, Dominguez Hills must display a current/valid CSUDH parking permit.  Permits must be displayed pursuant to Section 1.03.  (CSUDH parking enforcement staff will honor parking permits from other CSU campuses for general parking only.  Permits must be in plain sight.).

 

(a)                CERTAIN TIME EXCEPTED

 

Permits are required for parking on campus at all times and is indicated by signs posted at the entrances of all permit-parking areas.  General exceptions are: Graduation (Commencement) day, Sundays, legal and administrative holidays as observed by the university.  Any special events when Parking Officers are present for traffic control.

 

There is a five-day period prior to the fist day of instruction of each semester (Spring and Fall) when permits are not required for general parking (typically Monday-Friday).  Permits are required commencing with the first day of instruction for each semester.

 

Parking permits are required commencing the first day of instruction for Summer Session.  Due to overlapping sessions, no grace periods are granted.

 

(b)               CERTAIN AREAS EXCLUDED

 

Permits are not required in time restricted visitor parking/loading areas.  Vehicles exceeding the posted time restriction must obtain a permit from Parking Services prior to the expiration of this time restriction.

 

Permits are not required for disabled visitors to the university displaying a valid DMV Disabled Placard and/or distinguishing license plates.  (CVC 22511(a)(1)(B)).  Disabled students, staff and faculty must display a valid CSUDH parking permit with their DMV Placard.

 

Permits are not required for areas on the campus property leased for various activities, contracts, or special events.  These areas are identified as agricultural leases (farm vehicles, company vehicles, etc.), or other special groups/organizations. 

 

(c)                AVAILABILITY OF PERMITS

 

Parking permits are available for purchase through the Cashier’s Office located at SCC B135 during normal business hours.  Daily permits are available through permit dispensing machines located throughout the campus parking areas.

 

Permits requested for special events, VIP’s, or other visitors are requested through the Parking Services Office.  Requests for these permits must be submitted to the Parking Services Office via departmental correspondence (Department letterhead).

 

In most circumstances, special events may require the hosting department to purchase these permits, please contact Parking Services for these parameters.

 

(d)               RIGHT TO PARK

 

Parking permits/decals are the property of the university and may be invalidated, revoked, canceled or recalled.  The use of a parking permit/decal is limited to the person who purchases the permit/decal.  The permits/decals are not transferable except that they may be used for the purposes of implementing ride-share programs.    In the event of mechanical “break-down,” the end user may display their permit/decal in a substitute vehicle.  The window "static" permit can be removed for this purpose.

 

(e)                GUEST PERMITS

 

Guest permits are issued solely to guests of the university as described in section 1.02.  The Parking Services Office issues Guest permits only.  Requests for guest permits must be made at least two days in advance via memorandum.  Guest permits will not be issued to faculty, staff, or students.

 

Guest permits will be held at the Information Booth/Kiosk or at the State University Police Department.  Guest permit requests indicating they will be mailed are the responsibility of the requestor and will not be replaced if they are lost.

 

(f)                 INVALID PERMIT/DECALS

 

Canceled, forged, altered, copied, or unofficial permits/decals shall not be honored.  Any officer of the State University Police or Parking Services may confiscate these permits.  Any person who knowingly displays a canceled or expired permit/decal, plate or placard for the purpose of fraudulently obtaining parking privileges on the university may be subject to campus disciplinary action and/or penalties as set forth in the California Penal Code.

    

    (g)        LOST/STOLEN PARKING PERMITS

 

The loss or theft of a semester, summer or annual permit will be reported to the Parking Services Office.  A handling charge will be assessed to obtain a replacement.

       

SECTION 1.02 – SPECIAL PERMITS

 

The Parking Services Office under special circumstances may extend parking privileges via permit.  The user of such a parking permit is subject to the express limitations on the permit.  Such permits will be valid only during the times and in the areas designated in writing on the permits at the time of issuance.

 

No unauthorized individuals or departments may grant special parking privileges.  Special issuances are allowed in the following circumstances:

 

(a)    Persons not employed by the campus, visiting the campus for the purpose of transacting state business.  Such as:

 

1.      Campus advisory groups officially sanctioned by the university.

2.      Vendors and contractors performing duties contracted by the university while parked in a specific area designated by Parking Services.

3.      Dignitaries or government officials visiting the campus in an official capacity.

4.      Major donors of the university sanctioned by University Relations or the office of Development.

 

(b)    Persons on non-paid status such as “volunteers.”  The host department will request this privilege via memorandum to Parking Services.

(c)    Student recruitment.  This includes campus tours, pre-admission counseling, orientations, etc.  Host department will submit their request to Parking Services.

(d)    Campus community events.  These are not limited to “town hall” meetings, community teleconferencing, etc.  Host department will submit their request to Parking Services.

 

Special consideration for parking shall be authorized by and coordinated with the Parking Services Office.  The following conditions will apply:

 

(a)    Generally, parking enforcement shall occur at all times except as noted in this policy.  If cancellation of enforcement is required, written approval must be obtained prior to the event from the Chief of Police, or the Parking Administrator.

 

(b)   Distribution of special parking permits is the responsibility of the department(s) or organization(s) who are responsible for the event.  If special permits are to be mailed to attendees, the organizers are responsible.  Permits will not be replaced if stolen or lost.

 

(c)    Advanced notification of 14 days is required to Parking Services for any requests.  Failure to comply may result in financial charge-back for personnel to accommodate the event. 

 

(d)   Permits are limited to designated parking lots, which shall be assigned by Parking Services.

 

SECTION 1.02.1 – STUDENT HOUSING

 

Special parking lots for the residents of student housing are designated for their exclusive use (Lots 5 and 5A).  Student housing residents must display a special “R” parking permit and a valid CSUDH parking permit.  The “R” permit is issued without charge by the office of student housing and are non-transferable.  (There is a charge for replacement “R” permits).

 

Guests to student housing must purchase a temporary permit from the office of student housing.  This permit must be displayed on the vehicle’s dashboard (in plain sight).

 

SECTION 1.02.2 – FACULTY/STAFF PARKING

 

Specific signs, curb markings or pavement stencils, designate special parking areas for faculty and staff.  Faculty and staff must display a valid annual or semester parking permit to utilize these spaces.  Daily permits purchased at a dispensing machine are not honored.

 

SECTION 1.02.3 – SPECIAL PERMITS/EMERITUS

 

Special “emeritus” parking permits are issued by the campus administration to all faculty and staff who have retired from California State University, Dominguez Hills.  These permits allow the holder to utilize faculty/staff parking spaces.

 

SECTION 1.03 – RESERVED PARKING AREAS

 

The university has designated “Area 100” as special reserved parking for Vice Presidents and Deans.  A special permit must be displayed for parking in these areas.  Persons other than Vice Presidents or Deans must secure the approval of the university’s President.

 

The office of Parking Services issues the 100 Area permit.  This permit requires the holder to pay an additional fee via payroll deduction.

 

SECTION 1.04 – DISPLAY OF PARKING PERMIT

 

Parking permits/decals are not valid unless properly displayed in plain sight with all numeric designations, expiration date right side up. 

 

Window “static” permits must be displayed on the front windshield (driver’s side), lower corner.  Permit holders are advised to discard expired permits and not clutter their front windshield (CVC 26708).

 

Daily, guest, and special parking permits must be displayed on the driver’s side dashboard.  The permit must be in plain sight, right side up.

 

Motorcycle permits must be affixed to the front fork of the vehicle or fairing.  Should the motorcyclist elect to purchase a daily permit, it should be taped to the vehicle’s front fork or fairing.  It is suggested that the cycle’s license number be written on the face of the permit to deter theft.

 

SECTION 1.05 – APPLICATION OF POLICY/REGULATIONS

 

(a)                The provisions of this policy prohibiting the stopping, standing or parking of a vehicle shall apply except when it is necessary to stop a vehicle to avoid conflict with other traffic or in compliance with directions of a police officer, parking officer, or official traffic control devices.

 

(b)               All applicable provisions of the California Vehicle Code pertaining to the parking of vehicles shall apply anywhere on the university or upon any of the    grounds or parking facilities owned or controlled by the university, pursuant to Section 21113 of the California Vehicle Code.

 

(c)                A notice of parking violation of any section of this University Parking Policy or the California Vehicle Code will be attached to the vehicle parked, stopped or standing in violation.

 

SECTION 1.06 – RESTRICTED PARKING AREAS

 

Where spaces are appropriately posted to indicate that parking is restricted to the use of certain individuals or vehicles, all vehicles parked in such spaces must conform to the posted restrictions or are required to have the express permission of the Chief of Police (State University Police), Parking Administrator or their designee.

 

Spaces referred to include, but are not limited to, those spaces set aside for persons with physical disabilities, car/van pool, special permit, and service vehicles.  Unless exempted by the California Vehicle Code, vehicles using such restricted parking places must display the appropriate university parking permit(s).  Unless posted otherwise, restricted parking spaces are enforced 24 hours a day, seven days a week (year-round).

 

(a)                CAMPUS WALKWAYS

 

The driving and parking of vehicles on the campus walkways is strictly prohibited.  Exceptions to this restriction may be provided if prior arrangements have been made with Parking Services.  A vendor/service permit must be properly displayed or clearance obtained for any vehicle parked on the walkways from Parking Services.  Only university service vehicles and emergency vehicles may drive or park on the walkways.

 

(b)               CONSTRUCTION SITES

 

Only contractors, subcontractors and their employees may park within the construction site (fenced area).  Those contractors, subcontractors and employees who chose to park in university parking facilities must display a valid parking permit at all times.

 

SECTION 1.07 – CURB MARKINGS AND SIGNS.

 

Pursuant to provisions of the California Vehicle Code, the university has adopted the following guidelines regarding curb markings and signs:

 

(a)    RED shall mean no stopping, standing or parking at any time except that a bus may stop in a red zone marked or signed as a bus zone.

 

(b)   YELLOW shall mean a loading zone.  This space is for the exclusive purpose of loading or unloading of passengers or materials.  This loading or unloading shall not consume more than 30 minutes.  Extended periods of time will require the user to obtain a permit from Parking Services.

 

(c)    WHITE shall mean no stopping, standing or parking for any purpose other than the loading or unloading of passengers only. 

 

(d)   GREEN shall indicate a visitor’s parking stall.  This space is for the exclusive purpose of visitor parking and is limited to 30 minutes.  Extended periods of time may be granted by obtaining a permit from Parking Services.

 

(e)    BLUE shall mean parking for persons with disabilities.  This space is for the exclusive use of those holding DMV issued disabled placards or distinctive disabled license plates. 

 

The zones described above shall be applicable at all times, 24 hours a day, seven days a week, year round.  Including holidays.

SECTION 1.08 – PARKING SPACE MARKINGS

 

The university has marked parking stalls in all designated parking areas.  No vehicle shall be stopped, left standing or parked other than within a single marked space.  Only one vehicle per parking stall is permitted.

 

Oversized vehicles using university parking spaces should contact Parking Services for a review and/or special permit.

 

Two-wheeled vehicles must park in designated parking areas.  Motorcycles, motor scooters and mopeds are to use designated motorcycle parking areas.  Bicycles will utilize designated bicycle racks only.  (CVC 22503.5)

 

SECTION 1.09 – OVERTIME PARKING

 

When authorized signs are in place giving notice and specifying specific time limits of parking on any portion of the university, no person shall park, store or leave standing any vehicle for a period in excess of the time limit.  In special cases, Parking Services who will issue the appropriate parking permit may grant extended time.  Some cases may require the movement of the vehicle to a general parking facility.

 

SECTION 1.10 – OVERNIGHT PARKING

 

There is no overnight parking in any university parking lot, unless prior clearance has been obtained from Parking Services. 

 

Parking facilities are considered closed 1 hour after the close of evening instruction.

 

SECTION 1.11 – TEMPORARY PARKING SIGNS

 

Parking Services is authorized to erect or place temporary signs appropriate to special events or to restrict parking.  No vehicle shall be parked or left standing in such temporary restrictions.  (CVC 22500)

 

SECTION 1.12 – PARKING PROHIBITED IN LANDSCAPED AREAS

 

No vehicle shall be left standing anywhere on the university in or upon any landscaped area.  Landscaped areas are considered to be any unpaved area that has been planted with turf, ornamental trees or shrubbery, or which has been graded or improved for purposes other than vehicle parking.  This includes but is not limited to undeveloped fields; agricultural areas or any paved or brick patio area.  Authorized university service or emergency vehicles are exempt.

 

SECTION 1.13 – PARKING PROHIBITED

 

No vehicle shall be parked in any area or upon any street or roadway or portion thereof when authorized signs or markings are in place prohibiting it.  Such signs will designate such areas by bearing the legend “NO PARKING ANYTIME, NO STOPPING ANYTIME, or NO PARKING.” 

 

SECTION 1.14 – BLOCKING TRAFFIC PROHIBITED

 

No vehicle shall be parked or left standing so as to interfere with or impede the normal flow of traffic.  (CVC 22400)

 

SECTION 1.15 – BLOCKING RAMPS PROHIBITED

 

No vehicle shall be parked or left standing so as to interfere with or impede the normal flow of traffic such as the movement of wheelchairs upon ramps installed for the purpose of assisting the movement of persons with disabilities.  (CVC 22522)

 

SECTION 1.16 – PARKING PROHIBITED ON SIDEWALKS

 

No motor vehicle shall be parked or left standing on any sidewalk in such a manner as to block impedes or hinders the movement of pedestrians.  (CVC 22500f)

 

SECTION 1.17 – PARKING IN A FIRE LANE PROHIBITED

 

No vehicle shall be parked or left standing within the boundaries of a designated fire lane.  (CVC 22500.1)

 

SECTION 1.18 – LODGING IN A VEHICLE PROHIBITED

 

It is unlawful to dwell overnight or lodge on campus any motor vehicle, motor home, trailer, boat, or house car on the grounds or roadways of the university without specific authorization from Parking Services.

 

SECTION 1.19 – PARKING SPACES FOR THE DISABLED

 

No motor vehicle shall be parked in, obstruct, block or otherwise bar access to those parking spaces designated disabled parking. Individuals who possess valid DMV placards/plates are prohibited from parking in restricted or reserved spaces/areas.  (CVC 22511.5)

 

SECTION 1.20 – LOITERING WITHIN A PARKING FACILITY

 

No person shall loiter or remain within a parking facility except to park or retrieve a parked vehicle.  Failure to comply may result in arrest pursuant to PC 602j.

 

SECTION 1.21 – REMOVAL OF MARKINGS

 

No person shall remove, obliterate or conceal any chalk mark or other distinguishing mark used by any police or parking officer in connection with enforcement of parking regulations.  Such an act shall constitute an infraction.

 

SECTION 1.22 – WEIGHT LIMITS

 

No person shall operate a motor vehicle in excess of any posted weight limit signs on campus roadways or parking facilities.  The present weight limits in all campus-parking facilities is 5 tons.  (CVC 35700)

Special clearance is required from Parking Services for any over weight or over sized vehicle on the campus.

 

SECTION 1.23 – REMOVAL OF VEHICLES

 

In accordance with the California Vehicle Code, any sworn officer of the State University Police or those employed to enforce parking regulations is authorized to tow away a vehicle at the expense of the owner.  (CVC 22659, 22651)

 

SECTION 1.24 – ADMINISTRATIVE COSTS

 

Pursuant to the California Vehicle Code, the State University Police may assess a charge equal to its administrative costs relating to the removal, impound, storage, or release of the vehicle impounded.

 

The impound release fee is payable to the cashier’s office (SCC B135) during normal business hours in the form of cash, check or money order.

 

Chapter 2

 

CITATIONS AND APPEALS

 

SECTION 2.00 – BACKGROUND

 

In order to facilitate the movement and efficient parking of motor vehicles on the campus, it is necessary to issue notices of parking violations to those motor vehicles found to be not in compliance of parking policy and regulations outlined in the California Vehicle Code. 

 

SECTION 2.01 – CITATIONS

 

If a vehicle is unattended during the time of the violation, the peace officer or person authorized to enforce parking laws and regulations shall securely attach to the vehicle a notice of parking violation.  (CVC 40202)

 

If the parking penalty is deposited and there is no contest as to that parking violation, the proceedings shall terminate.  (CVC 40204)

 

Should the respondent choose to contest the parking violation, the appeal shall be filed in accordance to Section 2.02.  (CVC 40205)

 

If the respondent loses their copy of the parking violation, Parking Services may charge a fee to reproduce the citation.  (CVC 40206.5)

 

 

SECTION 2.02 – APPEALS

 

Citations must be appealed with twenty-one (21) days of the violation date.  Appeal forms are available from the State University Police or Parking Services Office.

 

After approximately 3 weeks, the registered owner of the vehicle will receive a mailed Notice of Delinquent Parking Violation.  This administrative notice will allow the registered owner of the vehicle two (2) additional weeks to appeal or pay the parking penalty.  After the due date indicated on this notice, an additional administrative fee will be assessed.  The vehicle’s registration will be placed on administrative hold until the penalty is paid or clearance is obtained.  In some instances, students will have services placed on hold until such delinquent penalties are paid.

 

There are three levels of appeals:

 

First Level

 

The respondent will submit a request for Administrative Review (Initial Review) within the parameters established by the California Vehicle Code.  This request must be submitted within 21 days of the violation date, or before the due date as indicated on the Notice of Parking Violation.   There is no charge for this appeal.

 

 

Generally, the parking violation will not be dismissed based on acts of omission on the part of the person cited.  These omissions are:  Lost or forgotten permit, improperly displayed permit, not knowing the parking regulations, and not seeing the signs. 

 

Parking Services will process the request for Administrative Review.  A determination will be returned to the respondent indication the violation’s disposition within two weeks.

 

Second Level

 

Upon receipt of the results from the Administrative Review, the respondent may elect to escalate the appeal to the Administrative Hearing.  The Administrative Hearing must be initiated within 21 days of the Administrative Review.  The respondent will prepay the parking penalty and submit a request for Administrative Hearing form.  The request for the Administrative Hearing should have a copy of the Administrative Review and citation affixed at time of submittal.  The respondent has the option of having a hearing with the Hearing Officer/Examiner or a review via mail.  The respondent will be notified via phone call or letter indicating the date, time, and location of the Hearing. 

 

If the Hearing Officer/Examiner finds in favor of the appellant, the parking penalty will be returned.

 

Third Level

 

If the appellant does not prevail after the Administrative Hearing, they may request a municipal court de novo hearing (Compton Municipal Court).   This last level must be initiated within 30 days of the Administrative Hearing. 

 

Any questions pertaining to this third level appeal should be directed to the municipal court.

Chapter 3

 

ENFORCEMENT

 

SECTION 3.00 – AUTHORITY

 

It shall be the duty of the members of the State University Police, Parking Services and such persons authorized by the Chief of Police, to enforce all of the provisions of this policy and all applicable provisions of the California Vehicle Code on the grounds of the university, as provided by applicable sections of the Education Code of the State of California.

 

SECTION 3.01 – REQUIRED OBEDIENCE TO PARKING POLICY

 

Violations of this policy or the California Vehicle Code are subject to the court of jurisdiction (Compton Municipal Court) in accordance with applicable provision of law.  Employees may be subject to administrative discipline and students may be subject to student disciplinary actions.

 

SECTION 3.02 – EXEMPTION OF CERTAIN VEHICLES

 

(a)    The provisions of this policy relating to the operation, parking and standing of vehicles shall not apply to any vehicle or to the operator of any marked police or fire departments, any public ambulance or any public utility vehicle, when such vehicle is operated in the manner specified in the California Vehicle Code in response to a call for service or emergency.  State University Police and Parking Services shall be exempt from the provisions of this parking policy.

 

(b)   The foregoing exemptions shall not, however, protect the driver of any vehicle from the consequences of his/her willful disregard for the safety of others.

 

(c)    Any vehicles of the CSUDH Physical Plant or firms under contract to the university will in use for the construction or maintenance work upon the grounds of the university, any vehicle used by the U.S. Postal Service or the campus mail service for collection, transportation or delivery of the U.S. Mail, or other vehicles may be exempted from some or all of the provisions of this policy by Parking Services or the State University Police.

 

SECTION 3.03 – TRAFFIC CONTROL DEVICES

 

No provision of the California Vehicle Code or of this policy, for which signs are specifically required for enforcement, shall be enforced against an alleged violator unless appropriate signs are in place and are sufficiently legible to be seen by an ordinary person, giving notice of such provisions of the traffic and parking regulations intended to be in force.
